Terms and Conditions of Sale (TCS)
1. Scope of Application
– These Terms and Conditions apply to all transactions made on www.braaimaster-swiss.ch and govern contractual relationships with Solutions Custom Made Sarl.
– Any customer condition that conflicts with these Terms and Conditions shall be considered null and void.
– Solutions Custom Made Sarl reserves the right to modify these Terms and Conditions at its discretion and without prior notice, with modifications becoming effective as soon as they are posted online.
2. Offers and Formation of the Contract
– The information presented in the catalogs and on the website is for informational purposes only and is not contractually binding.
– The customer's confirmation of the order via the online confirmation button constitutes a binding commitment.
– Solutions Custom Made Sarl will acknowledge receipt of the order without delay.
– In the event of unavailability or pricing errors, the customer will be contacted to find an alternative solution.
– Product specifications (plans, dimensions, weight, etc.) are provided for informational purposes only and do not constitute a formal guarantee, unless explicitly stated otherwise.
3. Identity of the Contractor
– Solutions Custom Made Sarl, located at the email address info@braaimaster-swiss.ch.
4. Delivery
– Delivery by Post, DHL, or carrier in Switzerland, to the nearest curb.
– Standard delivery time of 1 to 3 weeks, specific delivery time for special orders.
– Delivery dates are provided for informational purposes only, unless otherwise agreed.
– Solutions Custom Made's responsibility is limited to timely delivery by its suppliers.
– For deliveries that include installation, access must be provided by the customer.
– Any complaints regarding visible damage or damaged packaging must be made upon receipt, and within 4 days for non-apparent defects.
5. Payment and Retention of Title
– Accepted payment methods: Credit card, TWINT.
– Ownership of the goods remains with Solutions Custom Made until the invoice has been paid in full.
6. Purchase on Invoice
– Purchase on account is subject to conditions and managed by a third party. Solutions Custom Made Sarl remains responsible for the performance of the contract, excluding collection.
7. Retention of Title
– Ownership of the items remains with Solutions Custom Made Sarl until full payment has been received.
8. Warranty
Braaimaster barbecues are covered by a 2-year warranty against manufacturing defects, starting from the date of purchase and subject to normal use in accordance with the instructions for use.
The Braaimaster warranty applies in the event of normal use. Normal use implies that the fire is lit in the appropriate firebox or on the charcoal tray. Flames and direct heat against the inner sides of the Braaimaster must be avoided.
Rust, deformation, and discoloration of parts in direct contact with the fire are excluded from this warranty.
The warranty does not apply to supplied accessories such as grates, firebox, ember tray, or other replaceable parts or accessories of the Braaimaster.
Minor variations in dimensions, weight, or color are not considered a defect in the construction of the product.
Rust on Braaimasters does not affect the longevity of the product, can be brushed off, and therefore does not constitute grounds for warranty coverage.
Damage caused during installation or improper installation is not covered by these warranty terms and conditions.
The warranty does not cover the following: wear and tear, abuse or misuse, failure to use the product for its intended purpose, any modifications/repairs carried out by you, damage to the exterior of the product, including accidents, force majeure (fire, water damage, lightning, storms, etc.).
Any defect covered by these warranty conditions will be assessed by a Braaimaster representative and a recommendation will be made for repair or replacement. Braaimaster's decision is final.
Braaimaster and Braaimaster dealers are in no way liable for any damage or consequential damage resulting from or via the use of a Braaimaster product.
Braaimaster and Braaimaster dealers are not liable for installation or delivery costs in the event of replacement of a Braaimaster product following invocation of these warranty conditions.
9. Return
– Product returns are subject to conditions and must be approved in advance by Solutions Custom Made LLC.
– Products must be returned within 10 days of receipt, in their original condition and packaging.
– Return shipping costs are the responsibility of the customer, who is also responsible for packaging the item for return shipping.
10. Data Protection
– Solutions Custom Made Sarl is committed to protecting customers' personal data.
11. Liability
– Solutions Custom Made Sarl accepts no liability for indirect damages arising from the use of its website or orders placed.
12. Miscellaneous Provisions
– The place of jurisdiction is the registered office of Solutions Custom Made Sarl. Swiss law applies.
– If any provision of these Terms and Conditions is deemed invalid, the remaining provisions shall remain in full force and effect.
